TERMS AND CONDITIONS FOR THE USE OF THIS APP
The present document defines the rules for access and use of the Birdie App, hereinafter referred to as “App”.
These rules are related to Birdie Experiences, Lda, hereinafter referred to as “Birdie”.
Intellectual and Industrial Property Rights
The present App and all its contents are property of Birdie. It is, hence, forbidden to replicate, modify, publish, broadcast, transfer, distribute or sell any contents, images, commercial brands, signals and distinctive signs, graphic design, codes and computer software without the due consent and authorization of Birdie.
Access and conditions for use
The user may use the App, but any copy must have the prior consent of Birdie. The user is obliged to the proper use of the App contents, which shall not be utilized for any illegal activity, contrary to public policy, good manners, national defense or public health.
Alteration and Availability
With the purpose of improving the contents of this App, Birdie reserves the right to modify or temporarily suspend it, without prior warning.
Limitation of Liability
The user is entirely responsible for the access and use of this App. Birdie will not be held responsible for any negligence, damage or loss of profits, business loss of benefices or data that will result, directly or indirectly, from the use or access to this App or of the services provided by Birdie. Birdie will not assume any guarantee or liability for any damage and losses of any nature that might result from:
- Malfunction of the present App or page functioning.
- Lack of utility, inadequacy or lack of validity of services and contents provided by this App, according to user results and expectations.
- The existence of viruses or programs in the user’s computer or device.
Birdie will of course give back the money to the users who might have purchased one of the products available in the App, in accordance to our 100% or money-back guarantee and no questions asked policy.
Birdie tries to guarantee the accuracy of all information contained in the present App. The App’s contents are genuine and strictly for informational purposes, supported by the rigorous research that guides Birdie. Nonetheless, errors might occur and Birdie shall not be held responsible for any eventual loses, damages or any other consequence this might have.
Conditions for accessing and utilization of the present site comply with Portuguese legislation and the Oporto District (“Comarca”) Courts shall have jurisdiction to determine any questions arising from the general conditions herein announced.
With this document, we wish to ensure that:
- You understand the information we collect.
- You understand the reasons why we gather that information, as well as its utilization.
Birdie asks you to provide some of your personal data including name, email address, phone number, home address, as well as any other type of information that you may wish to provide. When you navigate through this App, Birdie does not collect nor handle any personal data. Those data are only gathered when you communicate with us, via a purchase, filling out a form, or when you subscribe to our newsletter. Our App only gathers data related to your navigation – interaction, basic demographic data, “page views”, location, etc (verify Cookies Policy).
Furthermore, in order to complete one of the videos available in the App, there is the need for the user to upload the videos they film. These will be exclusively used for the purpose of creating the video for the user, unless the user agrees otherwise.
Unless you agree otherwise (e.g., if you subscribe to our newsletter), the personal data Birdie collects will not be used for any purposes rather than for issues related with your purchase with us and the creation of your video.
Birdie will never provide your personal info to any third parties.
The right of rectification of personal data – you have the right to request the correction of the data that we have about you, if they are not correct, or have undergone changes.
The right of access to personal data – you have the right to request a copy of your personal data.
The right to data portability – you have the right in certain circumstances to request the personal data you have provided us.
The right to oppose the processing of personal data – you have the right to object to the processing of personal data if you do not want to receive emails for marketing purposes or newsletters.
The right to limit the processing of your personal data – if you consider that your data is incorrect or if you believe that we should not process it.
The right to be forgotten – you have the right to permanently erase your data from our databases whenever you request it. Once this right has been exercised, and after all due diligence (including the acquisition of one of our videos), your data will be deleted from our databases, following Birdie’s procedures for handling and handling requests.

Personal data provided by users are incorporated in an automated data file, of Birdie’s entire responsibility, and will be used only for the purposes identified. Birdie will adopt technical and organizational measures, suitable to ensure a level of security adjusted to the level of risk, namely personal data encryption and pseudonymisation; we will ensure permanent confidentiality, integrity, availability, and resilience of our systems and of data handling services; we will guarantee availability and access to personal data so the efficiency of the adopted measures may be regularly evaluated, in order to guarantee safety of data handling.
As a user of the site, you will authorize your personal data (full name, email address, phone number, home address or other information that Birdie might solicit, or that you might provide voluntarily) to be collected, handled and stored by Birdie.
Birdie reserves the right to exercise its rights, in accordance with the law, namely, the right to information, access, rectification, opposition and elimination of its data processing. As a user, you reserve the right to access, edit or remove the data that concerns you and that may be in the process of data processing by Birdie. The right to access, rectification and elimination of personal data may be exercised at any moment, by sending an email message to firstname.lastname@example.org requiring it.
